Petitioning Prosecuting Crown Attorney of Ontario Court of Justice
PETITION BACKGROUND (from "Windsor Star" and “CBC News articles at the links below):
The “Group of 14” include seven shih tzu-type dogs which were seized from a Windsor, Ontario woman’s home on June 10, 2016 following the execution of a search warrant by Windsor Essex/County Humane Society officers and Windsor police. This was executed, following a tip from the public for an alleged puppy mill in the city. Seven more dogs were found dumped in various locations, by the owner in Windsor and Tecumseh after the owner allegedly learned the humane society was investigating her. The investigation shows the woman was breeding the dogs. She advertised them as shih tzus, Yorkshire terriers (Yorkies) and Havanese dogs.
The dogs were seized, living in “filthy conditions”, with one male carrying almost three kilograms, or about seven pounds of excrement dried in clumps resembling rocks hanging from his overgrown fur. All the dogs have dental problems. The dogs have been surrendered to the Humane Society, being cared for and treated medically and behaviourally, and will be made available for adoption as soon as they are ready. One dog who had also been abandoned by the owner is still missing.
Candace Kwasnicki is facing 14 counts of permitting distress to an animal under the Ontario SPCA Act.
THE PETITION:
We, the undersigned, respectfully request that, IF the accused is convicted, the Crown Attorney advocates for the maximum sentence possible on all 14 counts, including a ban from owning, having the custody or control of, or residing in the same premises as an animal or a bird for the rest of her life, and restitution for the care of the “Group of 14”. We make this request recognizing that animals are sentient and vulnerable beings who rely upon the courts to ensure sentences reflect appropriate deterrence and denunciation of people who are convicted of harming them (as well as people who would consider harming them) even through neglect. Further, it has been well-demonstrated in research that people who harm animals have the potential to also harm humans, so our communities will be safer if the courts take animal cruelty seriously and impose meaningful sentences in such cases.
