Constitutional Challenge to Medicare to go to trial in 2014

We risk losing Canadian Medicare as we know it.

Dr. Brian Day, owner of Vancouver’s for-profit Cambie Surgery Centre and the leading proponent
of privatized health care, has launched a constitutional challenge to break Medicare via the courts
and establish a US-style system in Canada.

Parties in the case are calling this the most significant constitutional challenge in Canadian history.

The BC Health Coalition and Canadian Doctors for Medicare are interveners in this case. This means that we are participating directly in court to defend Medicare.

The clock is ticking. Legal preparations have already begun with the trial set for fall 2013.

Though this case has been launched in B.C., it will almost certainly advance to the Supreme Court of Canada.

The Supreme Court’s decision would apply across the country – and could be one that
destroys Medicare in Canada.


This challenge aims to break Medicare in Canada by striking down provincial health legislation
that limits the for-profit delivery of medically necessary services, claiming that these rules violate
the Canadian Charter of Rights and Freedoms.

Together we need to make sure that this legal attack is defeated.

The future of our public health care lies in the balance.

Thank you to the BC Health Coalition community for sending thousands of messages to
Fraser and Vancouver Coastal health authorities telling them to scrap plans to bill seniors
a monthly fee to use wheelchairs in our public residential care homes.

Thanks to your action, Vancouver Coastal has backed down from charing fees, citing public
backlash.

Now we need to make sure Fraser Health does the same.

Send your message now to demand that Fraser Health Authority follow Vancouver Coastal's lead and stop charging seniors for wheelchairs.
