On Earth Week, we want to highlight the courage and tenacity of youth, elders, Indigenous nations, and community members all over BC and Canada who are speaking up for the environment and their communities, both inside and outside the courts – from Gitxaała Nation’s landmark legal action for mining justice in BC, to communities mobilizing to hold polluters accountable through climate litigation.

Witnessing all the different ways people are stepping up to protect the planet in their own ways inspires us to keep up our work at West Coast. Read on to learn more about some powerful legal efforts to heal nature and pursue justice.

Sm'ooygit Nees Hiwaas et al v BC mineral tenure case heard in BC Supreme Court Gitxaała Nation's legal challenge to reform the Mineral Tenure Act could be a game-changer for Indigenous, environmental and human rights in BC.

The independent Human Rights Commissioner intervened in the Gitxaala Nation and Ehattesaht First Nation's cases challenging the Province's registration of mineral claims on their territories with no prior consultation. Check out the oral submissions of counsel for the Commissioner.
Should environmental offenders like Coastal GasLink be granted injunctions? BC has a problem with repeat environmental offenders that it doesn't seem able or willing to correct. The optics are even worse when the BC Supreme Court issues injunctions in support of companies that repeatedly break the law – like Coastal GasLink.

Sapsuckers, salamanders and owls: A community-led effort to protect wetland wildlife from Trans Mountain construction Read about how our Environmental Dispute Resolution Fund (EDRF) helped a BC resident work to protect local waterways and wetlands – home to many wildlife species like birds, squirrels, and salamanders – from harm caused by Trans Mountain construction.

Through the EDRF, West Coast is fortunate to work with environmental defenders from all over BC, to tackle challenges big and small – from saving local wetlands, to prosecuting polluters and advocating for strong laws to safeguard nature.
