Dear Friends,

Imagine being accused of a heinous crime you did not commit. Imagine being denied the ability to question your accuser’s flimsy evidence in court. Imagine a judge tearing you away from your partner and children for you to languish in solitary confinement for three years in a foreign jail. And imagine your government being complicit in your imprisonment.

Dr. Hassan Diab has faced this living nightmare since he was accused by the French government of orchestrating a 1980 terrorist attack, and the federal government’s extradition laws have utterly failed to protect the rights of this innocent person and his family.

Canada’s extradition laws must change.

The unjust treatment of Dr. Diab and his family shows the systemic injustice of our extradition system.

These laws require Canadian courts to treat untested, unproven summaries of evidence provided by a foreign state as reliable, and does not require prosecutors to disclose evidence that might help establish that a person is innocent. As a result, evidence that would have eliminated Dr. Diab as a suspect was kept hidden from Canadian courts.

The Canadian court considering France’s extradition request said that the case was so weak that he would never be sent to trial in Canada. Yet, it had no choice but to extradite Dr. Diab due to our current extradition law.

Now, despite findings from French investigating judges that France’s allegations are groundless, the French government is continuing to pursue Dr. Diab in court.
