Breaking news! Friday morning Justice Sharon Matthews issued an injunction prohibiting “Taseko, its agents and employees” from undertaking a drilling program at Teztan Biny (Fish Lake).

Justice Matthews found that the drilling program would interfere with Aboriginal rights and significantly disturb the area around Teztan Biny, with the only tangible benefit being to “provide jobs over a few months.”

Dismissing Taseko’s argument that the company would suffer “irreparable harm” if not allowed to start drilling before January 2020, Justice Matthews pointed out the “considerable uncertainty around Taseko ever operating a mine. The temporary loss of an ability to collect undefined data for an undefined or only vaguely defined purpose does not amount to significant harm.”

What does this victory mean for Teztan Biny? The injunction will stay in place until the Tsilhqot’in main case — a civil claim for infringement of Aboriginal rights over the 2017 exploration permits granted to Taseko - is heard. The hearing date for the main case has not yet been set, but Justice Matthews anticipates it would take 18 months to 2 years. The injunction gives the Tsilhqot’in significant breathing room to prepare their main case without worrying about Taseko’s heavy machinery desecrating a special, sacred place.

In the coming months, stay tuned for updates about the Tsilhqot’in civil case - the only strategy that can prevent not just Taseko’s zombie mine but future mining proposals at Teztan Biny - and ways to support. But now, let’s celebrate!
