Dear friends and supporters,

This fall, the federal government attempted to overturn our historic judgement from the BC Court of Appeal ordering an end to indefinite, prolonged solitary confinement by seeking leave to appeal this judgment to the Supreme Court of Canada.

Now, we have sought leave to cross-appeal in order to defend the rights of prisoners.

In June 2019, the BC Court of Appeal ruled that the existing laws are unconstitutional because they permit prolonged, indefinite solitary confinement.

While this was a significant victory, that decision did not go far enough in protecting prisoners’ rights.

The BC Court of Appeal refused to impose a hard cap on the number of days prisoners spend in solitary confinement. It also failed to recognize how the current law discriminates against Indigenous, disabled, and mentally ill people in prison.

Parliament passed legislation this summer to replace the existing solitary confinement regime. However, this replacement legislation may continue the practice of prolonged, indefinite solitary confinement by another name, as it too fails to place an absolute limit on the time a person can spend in isolation.
