Courts and international bodies consistently find that prolonged solitary confinement is cruel and unusual punishment, but our federal government continues to fight to preserve its use in federal prisons.

The BCCLA is fighting to end this practice for good. The negative effects of prolonged solitary confinement are horrific – and include psychosis, hallucinations, and suicidal behaviour. There are better, safer alternatives to solitary confinement that do not exact this devastating human toll.

In June, the BC Court of Appeal ruled partially in favour of our case with the John Howard Society of Canada, holding that Canada’s laws governing solitary confinement in federal prisons are unconstitutional. While this was significant, the ruling failed to impose a time limit on the practice or recognize how these laws discriminate against Indigenous people and people with mental disabilities.

Now we are taking the fight all the way to the Supreme Court of Canada. If the court grants leave, our case will likely be heard in 2020.
