Dear friend and supporter,

This year marks the 13th anniversary of my husband Mohamed Harkat's arrest under a secret trial Security Certificate. Moe was detained behind bars for 43 months and has been held under several types of house-arrest/bail conditions (the toughest in Canadian history) over the past 13 years. All that, without ever being charged or knowing the so-called evidence against him.

During the middle of the election campaign, Moe was suddenly issued his inadmissibility letter under a Harper government, kickstarting a deportation process against Moe that has him fighting forced return to Algeria, where he is at great risk of detention, torture or death because of the never-proven allegations against him.

YOU CAN HELP MAKE A DIFFERENCE-YOU CAN SAVE A LIFE!!!



Under section 42.1 (1) of IRPA it states:

The Minister may, on application by a foreign national, declare that the matters referred to in section 34, paragraphs 35(1)(b) and (c) and subsection 37(1) do not constitute inadmissibility in respect of the foreign national if they satisfy the Minister that it is not contrary to the national interest.

Also, please consider forwarding to your friends, family, your union or any organization that you are a part of. Get them to send a letter too.

We are very far from our goal of 1000+ letters. Only 200 of you have emailed your letters so far.

*This is an opportunity to ask this new government to exercise its discretion and make a decision that is humanitarian and compassionate in the best sense of the words.

PLEASE EMAIL LETTERS BY February 5th, 2016 (new and final deadline.)
After all those support letters are collected, we will then request a personal meeting with the Public Safety Minister, Hon. Ralph Goodale and present him with the file (of support letters and supporting documents from groups/organisations) to prove that Moe should not be sent back to Algeria where his life is in danger.

Dear Minister Goodale,

I write concerning UN Convention refugee Mohamed Harkat, who faces deportation to torture from Canada to Algeria under a controversial Security Certificate.

I write to ask that you allow Mohamed Harkat to stay in Canada. Moe considers himself Canadian: he loves this country, he came here to escape persecution and for a better life, and he does not belong anywhere else.

Under an opening in the law governing Security Certificates (section 42.1 of the Immigration and Refugee Protection Act) you as Minister have the power to decide that allowing Mohamed to stay in Canada is not contrary to the national interest.

Mohamed has spent most of his adult life in Canada, and has built a strong and supportive network of family and friends who value his contribution to this country, to the community, and to their lives.

I believe Mohamed poses no danger whatsoever to the public or to public safety in Canada, but rather offers a positive commitment to the life he has created here.

But also, I know that Canadian and international law prohibit complicity in torture, and there is no doubt that Mohamed’s deportation to Algeria would be a deportation to torture, or worse. Amnesty International has exposed Algeria’s poor human rights record, and I fear for Mohamed’s fate.

Under a Security Certificate, Mohamed has been detained without charge and without evidence for thirteen years. But I believe that he poses no threat, and that there is nothing to disprove his innocence.
Since 2009 all of the assessments done by CBSA, CSIS and Federal Court Justice Noel state very clearly that Mohamed is at the very low end of risk. In September 2009, the court dropped the conditions significantly after CSIS said that he was not the threat initially thought.

Moe respects his conditions completely and would never do anything to jeopardize them or to let down the large circle of family, friends and supporters he has built here over the years. He has become a recognized figure across the country, and he understands how important that is to us all.
It is hard to imagine how difficult life has been for Mohamed and his wife Sophie, who have had to deal with secret allegations, separation and long-term solitary confinement, very invasive house arrest conditions that completely robbed them of privacy, and the kinds of accusations that can ruin one's reputation and life. And yet from what I can see, they maintain a hopeful, positive attitude, believing in a sense of justice prevailing.

I urge you to use your unique position as Minister, and the discretion afforded to you under the law, to exempt Mohamed Harkat from deportation and let him stay and live a productive life in Canada.
