Dear PAOV

You've been part of supporting one of the most important Indigenous legal cases in Canada's history. Now, finally, the day has come: Beaver Lake Cree are in court!

On Tuesday, Feb 19, Beaver Lake Cree Nation will be arguing a key motion in their precedent-setting constitutional challenge over the violation of their Treaty rights and the devastation of their lands.

This is a Nation who've fought, who've refused to be silenced, and who've made sacrifices to force protections to land, air and water that will benefit everyone. We all owe a debt of gratitude to this tiny Nation who are standing toe to toe with Canada and Alberta to press for the honouring of treaty rights and an end to unchecked tar sands development in Alberta.

From Feb 19 through Feb 21, Beaver Lake Cree will be arguing their Advanced Cost Motion which seeks an exceptional court order that the governments of Canada and Alberta contribute to the costs of the litigation. This is the same mechanism that made it possible for the Tsilhqot’in to sustain nearly two decades of litigation, and win their historic title case.

“Beaver Lake’s case raises pressing issues of fundamental importance to the Treaty relationship and reconciliation, but not yet considered by the courts – to what extent does Treaty 6 protect a meaningful way of life, and to what extent is the Crown obligated to consider cumulative effects on the meaningful practice of that way of life when it authorizes development.” - Karey Brooks, legal counsel for Beaver Lake Cree
