Last week the Supreme Court of BC agreed to formally hear an application to drop all charges against Fairy Creek defenders due to an abuse of process by the RCMP. The application is being advanced by lawyers representing our movement who feel the police misconduct is to such an extent that those who were charged with contempt should not be prosecuted.
This is a precedent setting case - if the application succeeds, it could pave the way for improvements to enforcement clauses of future injunctions. This means more protections for land defenders and more accountability for the RCMP. This could help our comrades in Wet’suwet’en territories too!
The full hearing is yet to be scheduled and is likely to take place in late 2022. In the meantime, industry continues to profit while ancient forests are clearcut, so we must hold the line!

From the Wilderness Committee: “The Nuchatlaht Nation are fighting in the Supreme Court to get their land back through a groundbreaking title case starting on March 21! Their hahoulthee (territory) includes a large part of Nootka Island off the rugged west coast of Vancouver Island which has been impacted by industrial logging and fishing for almost a century at the hands of the BC government and giant corporations.
Despite passing legislation around the rights of Indigenous peoples and promising to do better, the BC government has continued to throw up obstacles and fight against the Nuchatlaht. Public support is key to winning this precedent-setting case.”

What's next?
With the snow starting to melt we're seeing logging picking up, with giants being trucked out of Pacheedaht and Ditidaht territories every day. In the coming weeks we’ll start asking people to re-join us on the front lines.
This weekend the leadership of this movement met in person to discuss the coming season. In the next newsletter we will be providing more details about those talks.
