Gitxaała Nation has launched a ground-breaking legal challenge that takes aim at mineral claims granted under BC’s outdated Mineral Tenure Act.
Currently, the Province gives away mineral rights through an online system without consultation or consent of Indigenous nations – a system that Gitxaała says is both unconstitutional and inconsistent with the United Nations Declaration on the Rights of Indigenous Peoples.
West Coast Environmental Law is part of Gitxaała’s legal team in the case. And together with RAVEN Trust, BC Mining Law Reform Network and Gitxaała Nation, we’re excited to host “Groundswell: An Indigenous Mining Justice Summit” on Thursday, December 15.

Mineral claim staking on Lax k’naga dzol (Banks Island) in Gitxaała territory raises the painful spectre of the mess left behind by the nearby Yellow Giant mine, and the ongoing challenges faced by so many Indigenous nations from mineral claims and mining. Gitxaała is being joined in the courtroom by other Indigenous nations, advocacy groups and Indigenous organizations that see this case as a once-in-a-generation chance to take a stand against gold-rush era laws that violate rights and desecrate Indigenous lands and waters.
