209 Ways to Fail: Northern Gateway Conditions Demystified

After Northern Gateway’s lengthy, contentious joint review process, putting any faith in the ability of the National Energy Board to hold Enbridge accountable may feel foolish. And yet, the National Energy Board (NEB) may be the closest thing to an ally in government this project provides.

Right now, the Northern Gateway oil tanker and pipeline project is in a holding pattern while the federal cabinet reviews the recommendations from the NEB's Joint Review Panel. Barring delays or injunctions from any of the pending legal challenges, cabinet will announce its decision sometime in the next five months.

While there are, of course, all number of other legitimate hurdles, including ongoing First Nations legal challenges and the possibility the province could deny necessary permits, as of right now, cabinet approval and the 209 conditions recommended by the NEB are the only federal government-mandated steps standing in the way of bitumen-loaded tankers and Douglas Channel. Isn't it time they deserved a closer look?

Attaching conditions to approval of an energy project is common practice for the NEB. In theory, they allow the board to hold companies accountable for what they promise to do, while providing strict timelines (and, ideally, penalties) to ensure they comply. In practice, governments have been able to pick and choose the conditions to suit their tastes, as happened with the Mackenzie Gas Project.

However, the changes to the NEB Act in the spring of 2012 weren't all bad. A change in that piece of legislation means government can no longer discard the conditions attached to the recommendation.

In the case of Northern Gateway, conditions run the gamut from recommendations on spill prevention, pipeline coatings and valve placement; to habitat preservation for marine mammals, woodland caribou and freshwater fish; and proof of adequate consultation procedures with potentially affected First Nations.

All of them are grouped into three phases: pre-construction, construction and pre-operation and ongoing operations. Each phase has its own set of conditions, with some requiring an additional level of approval before the NEB will consider it ‘met.’ For Northern Gateway they breakdown as follows:

  • 130 conditions to be met before construction can begin;
    - 55 of which require additional approvals from the NEB or other government bodies.
  • 60 additional conditions to be met before the pipeline or marine terminal could start operating;
    - 18 of which require additional approval from the NEB or other government bodies.
  • 17 ongoing conditions required during the life of the pipeline project,
    - 2 of which require additional high-level approvals from the NEB.

What the NEB says, goes. Unless it doesn't.

While the NEB Act enshrines conditions recommended by a panel, if a government body strongly opposes certain conditions, it can refer them back to the NEB for reconsideration. At that time, the NEB can decide to make a change to the conditions, but is under no legal obligation to do so.

For most (but not all) of the recommended conditions for Northern Gateway, this is the case. However, the passage of Omnibus Bill C-38 gives the federal cabinet additional powers to alter or supplement certain recommended conditions if they fit within the scope of the Canadian Environmental Assessment Act (or CEAA).

For those who didn’t closely follow the steady dismantling of Canada’s ecological protections in the summer of 2012, a weakened CEAA reduced the number of federally protected navigable waterways in Canada from several million to 162 and limited the scope of environmental assessments to only studying effects of infrastructure development on “fish, aquatic species at risk, migratory birds and federal lands.” Should the federal cabinet choose to use the powers it gave itself through the CEAA, it could alter or reduce some of the specific conditions that seek to protect these areas.

Conditions of Note

Not all of the conditions set for the Northern Gateway pipeline are worthy of study. Most are fairly procedural: requiring regular filings of safety reports, providing lists of company stakeholders and supplying schedules for construction/maintenance and safety testing. Others are more complex. They include:

Consultation with Aboriginal Groups: Throughout the joint review process, Enbridge was regularly criticized for its lack of consultation with First Nations, particularly when it came to traditional land use. As such, it is not surprising that the NEB included these concerns among its conditions.

To meet pre-construction conditions, Enbridge must prove it consulted adequately with all potentially affected First Nations, that it has achievable plans in place to mitigate and repair the damage its construction and operation will cause to these traditional lands and that it has a clear plan in place for ongoing bilateral communication and consultation. According to conditions 53 to 56, all of this needs to happen (and be approved by theNEB) at least a year before Enbridge can begin construction on lands traditionally belonging to First Nations. Any changes must be filed at least six months before construction begins, with a second filing required 90 days prior to starting construction on traditional lands (conditions 89 to 92).

It is worth noting that lack of faith in both Enbridge and the Joint Review Panel’s commitment to listening to concerns from Aboriginal groups forms the basis for the legal challenge tabled last week by the Gitga’at First Nation.

Due Diligence for Watercourse Crossings: The National Energy Board defines watercourses as “permanent or temporary structures that are or will be constructed in, on, under, over, through or across a water body,” saying “these particular locations merit focus because of the associated environmental sensitivities, and complex design and installation activities.”

Late yesterday, at the last possible moment, the Harper Conservatives quietly revealed that they have decided to conditionally approve the Enbridge Northern Gateway pipeline and supertanker project.

Like us, we know many of you will be feeling extremely disappointed that this government is ignoring both the growing urgency of climate change and the overwhelming public opposition to this reckless mega-project.

All eyes will now be watching to see the reaction. The stronger our opposition to Enbridge Northern Gateway, the harder it will be to push tar sands pipelines through local opposition anywhere across Canada.

Yesterday the Canadian federal government approved the Enbridge Northern Gateway pipeline. This goes against all the input from First Nations along the route and by the waters where the tankers would travel.

So we’re moving. In order to fulfill our mandate to raise funds for First Nations litigation, we created a simple, straightforward page to raise funds. RAVEN is working with Gitxaala Nation - the first nation to ask for our help in fundraising. The nation is also among the first to be ready to launch legal action. RAVEN will work with other nations interested in joining them by launching legal actions against Northern Gateway.

First Nations have unique constitutional rights in Canada, and are united to fight this project in the courts and on the land. They vow it will never be built.

While First Nations legal rights are strong, going to court with the government and Big Oil is expensive and time consuming. That's why these nations need our help to raise funds for their multiple legal challenges.

The federal government has just approved the Enbridge Northern Gateway pipeline and tankers, subject to the 209 conditions set out by the Joint Review Panel last year.

It’s hardly a surprise, from a government that consistently ignores warnings from global climate scientists and prioritizes the interests of big oil over the interests of British Columbians.

This willful, reckless contempt for our democratic processes, for nature and for science-based decision-making is putting at risk nothing less than our food, our livelihoods and our very future.

If you feel disappointed, angry, or frustrated, if today’s decision feels like a slap in the face of all you hold dear, you are not alone. But take heart: the Enbridge pipeline is far from a done deal.

Today’s announcement doesn’t mean that Enbridge will be built.

This is our home we are talking about. We live here, we play here, we earn our living here. If you are anything like me, no doubt you have a special place somewhere in this extraordinary province that deeply connects you to who are, and who we are as British Columbians.

It was an expected but devastating decision.

Just minutes ago, the Harper government approved the Enbridge Northern Gateway pipeline -- against the wishes of the majority of Canadians.

But here's the thing: there's still time to stop the pipeline. Here’s how:

Enbridge has stated its commitment to renew conversations with First Nations and other communities in the pathway of the pipeline. Before shovels hit the ground, it has promised to address any “remaining concerns” these communities have.

Enbridge hopes it can sweep these conversations under the carpet, just like it’s been doing all along, and push the pipeline forward despite tremendous opposition. If we can hold Enbridge accountable to its promise, we can stop construction before it starts. If Enbridge actually engages in any kind of meaningful consultation, there's no way it will be able to get everyone to support the pipeline.

Tell Enbridge to honour its commitment to First Nations and affected communities, and to build the pipeline only if it gets 100% consent.

Enbridge meddled with the community consultation process leading up to this decision, which is exactly how it was effectively able to push the pipeline project through and win the government’s approval. Now it hopes to appear like the “good guy” who’s righting his wrongs.

But we know that this just another attempt by Enbridge to sugarcoat its plan to build the pipeline, despite the fact that most Canadians are opposed to it: over 130 First Nations, 8 out of 11 communities in the pipeline’s path, and more than ⅔ of all British Columbians have loudly said “NO!”.

Decisions affecting First Nations' rights and title must be made with free, prior and informed consent, and communities in the pipeline’s pathway must also get a say. If they are not on board, the project shouldn’t proceed. End of story.

Enbridge: Honour your promise to respect the rights of First Nations and affected communities - do not start construction without their approval.

A new ad campaign has been launched in Russia warning people not to buy Paraguayan beef because of the risk the ranching industry poses to the Chaco’s uncontacted Indians.

Russia is the biggest importer of Paraguayan beef.

Beef company Yaguareté Porá is destroying vast swathes of forest inhabited by uncontacted Ayoreo Indians in Paraguay to make way for cattle destined for Russians’ dinner plates. 


Satellite images have revealed that the company is destroying the last tracts of standing forest in the northern Chaco region of Paraguay, an area recently found to have the fastest rate of deforestation in the world.

Survival has launched an advertising campaign warning Russia to stop beef imports from Paraguay until the Ayoreo’s land is protected.

Contacted Ayoreo have demanded their legal right to the land being destroyed by Yaguarete Porá for more than twenty years.

Under Paraguayan and international law, the government has the duty to return the land to its ancestral owners: the Ayoreo.

Uncontacted Ayoreo depend on the forest for their survival, and face extinction if they come into contact with the ranchers.

RAVEN Update - A New Campaign So First Nations Have a Voice at Tar Sands Hearings

We have launched new fundraising campaign - because of a sudden and alarming change in practice by the Alberta Government and the Alberta Energy Regulator.

Chief Gladue: "It is really important for people to understand the we are up against a provincial government, a regulator and a very wealthy resource company, all with huge resources. It really is David versus Goliath."

On June 11, 2014, Beaver Lake Cree Nation, along with Whitefish Lake First Nation, filed an appeal with the Alberta Courts and the Alberta Energy Regulator (AER) after the AER shut out them out from providing input on an oil sands project that will affect their communities. The fundraising goal of this campaign is $100,000 - urgently needed now so they band can push back, fight the delay tactics and prepare for the legal battle in the fall, where the Court will determine if these First Nations can appeal the AER's decisions. Assuming the Court grants permission to appeal, these funds will also be required to fight the actual appeal.

WHY THIS MATTERS
• The AER's decision on this and other recently approved projects means the public and First Nations impacted by energy developments won't have a seat at the regulatory table to express their concerns, much less an opportunity to have their concerns addressed before a project is built.

• The AER’s decision represents a serious departure from past practices.

"The Government of Alberta has spent a lot of time and money in places like Washington and New York to promote the province's so-called "world class" regulatory system. How can a system that refuses to allow a voice for impacted communities be world class? I n reality, Alberta's regulatory system silences concerns which is more third world than world class. Alberta is saying one thing and doing something very different." ~ Chief Henry Gladue, Beaver Lake Cree Nation.

This is not just a First Nation issue. Rural Albertans are being frozen out of the process too. This should be a concern to everyone. First Nations, like other rural Albertans, live in the midst of these expanding developments. First Nations input is important to understand the effects of these projects on the land and on communities.

• The AER recently approved an oil sands project by Canadian Natural Resources Ltd. (CNRL) for a significant expansion of their Kirby in situ SAGD oil sands extraction project.

• The AER refused to hold a hearing before approving the project, despite objections from several Aboriginal communities.

As a deeply concerned citizen and a life-long Liberal supporter,I am writing to express my disappointment with your decision to vote No to an opposition amendment to the Fair Election Act Bill C-23, calling for an evidence based look at proportional representation.

I feel that there is tremendous support in Canada for an element of PR in our electoral system.

I am asking for an explanation as to why you voted NO to the amendment in question.I look forward to your response, which for me and I believe many other Canadians, is a very important issue.

The main reason that so many citizens support proportional representation is to ensure that every vote cast has some weight. Under our current system this is not possible. In fact, if you examine the numbers in your own riding - 2004 - 50%, 2006 - 52%, 2008 - 70%, 2011 - 57% - it is easy to see that close to half your constituents who cast ballots had wishes that could not be considered. Under a changed system it would be possible for all citizens to have representation, thereby broadening the discussion in Parliament, favouring consensus in developing legislation and policy. Surely a better way to reflect the voice and diversity of Canadian people and geography.

Thanks to everyone who attended, held a watching party for or tuned into the livestream of Bold Action: the Moral Call for Climate Justice on Tuesday! If you missed it, you can click here to watch the event.

At the event Reverend Lennox Yearwood told the crowd that “this is our movement’s lunch counter moment.”

He said it during a week when Stephen Harper joined Australian Prime Minister Tony Abbot to pledge to stop global climate action. The same week that our movement has been awaiting a decision on the Northern Gateway pipeline and heard that TransCanada plans to file their final plan for the Energy East pipeline in August.
