MLA Andrew Weaver Wins Libel Decision, Facebook Posting Says

Green politician 'thrilled' by ruling.

British Columbia Green Party MLA Andrew Weaver has won a libel decision against the National Post and four of its staff, he said on his Facebook page today.

"I am absolutely thrilled with today's BC Supreme Court judgment in my libel case against the National Post, Terence Corcoran, Peter Foster, Kevin Libin and Gordon Fisher," Weaver wrote.

Fisher is the president of National Post Inc. and publisher of the paper, Corcoran is the editor of the Financial Post and a columnist for the National Post, and Libin and Foster are National Post columnists.

Weaver launched the lawsuit in relation to articles by Foster on December 9, 2009 ("Weaver's Web"), Corcoran on December 10, 2009 ("Weaver's Web II") and January 27, 2010 ("Climate Agency going up in flames"), and Libin on February 2, 2010 ("So much for pure science"), according to an announcement from the time.

"I initiated the lawsuit in April 2010 after the National Post refused to retract a number of articles that attributed to me statements I never made, accused me of things I never did, and attacked me for views I never held," Weaver wrote on his personal Facebook page.

"I felt I had to take this matter to court to clear my name and correct the public record. This judgment does precisely that."

The Inter American Commission on Human Rights has released a 125 page report on the situation of “Missing and Murdered Indigenous Women in British Columbia, Canada.” The IACHR is the most significant human rights mechanism in the Americas; it is an arm of the Organization of American States.

The report refers graphically to the many and frequent realities among indigenous women of violence, murder, suicide, poverty, discrimination, marginalization, imprisonment, psychological harm, child apprehension, social and cultural deprivation, lack of housing, lack of education; and it overwhelms the imagination.

“Discrimination” is the root cause of disproportionately high incidences of murder and disappearance of Indigenous Women, according to the report’s findings. In fact, its key recommendation to Canada focuses on the resolution of that deadly discrimination:

“…This means addressing the past and present institutional and structural inequalities confronted by indigenous women in Canada. This includes the dispossession of indigenous lands, as well as historical laws and policies that negatively affected indigenous people, the consequences of which continue to prevent their full enjoyment of their civil, political, economic, social and cultural rights.”[i]

Discriminatory practices and norms of the colonial process are now firmly embedded in Canadian law; in Canadian institutions such as the RCMP and the public education system; have caused very recent historical harms; and permit prejudice in the mainstream culture and society. The Commissioners have focused on substantial evidence of these many kinds of endemic discrimination and the link it makes to “immunity” for those who commit crimes against indigenous women.

It’s the real and perceived lack of consequences for crimes against indigenous women which results in their being eight times more likely to be murdered than Canadian women. (p.49 #90)

The Commissioners referenced a dozen major United Nations human rights treaties in order to deal with Canada’s rejection of the IACHR report (pp.57-63). The Inter American Commission has jurisdiction to look into human rights issues which are covered in the American Declaration on the Rights and Duties of Man, a treaty applicable to every state member of the Organization of American States, but in making its formal observations on the IACHR’s report, Canada suggested it “is not bound by obligations contained in human rights instruments to which it has not consented to be bound.”

Industry hopes to bury it too, they just don’t know where yet. Currently, there are 13 communities in Ontario and Saskatchewan involved in the ‘Learn More’ process with the Nuclear Waste Management Organization (NWMO), including one just NW of Toronto. The final promise is a $20-billion dollar construction project to bury at least 4.6 million used fuel bundles.

Harper in closet over the economy as Canada heads toward another recession

Harper's recent incarnation as an anti-terrorist crusader has caught many Canadians by surprise. Harper is spending considerable political energy beating the drums of war against terrorists, and introducing a far-reaching, and much condemned, bill aimed at restricting free speech, and increasing police powers. But could this move hide a more cynical purpose? Can there be an ulterior motive?

I think there is, and the reason is quite simple. It's the economy. Seven years after the beginning of the crisis, and four years after the official end of the crisis, the economy is slowly (or not so slowly) heading in the wrong direction. In fact, I don't think we can exclude the possibility of a recession late in 2015 or early 2016.

Consider the economic facts. In 2014, the Canadian economy had a rather weak year. In November, the economy actually contracted by 0.2 per cent mainly as a result of a weak manufacturing sector. It is the economy's worst performance in almost a year: on a year-over-year basis, growth in Canada slowed to 1.9 per cent from 2.3 per cent in November.

What does create long-lasting change, is changing the hearts and minds of the people, and changing the consciousness of society. This is done by connecting to them on both an emotional and a logical level, not by just expressing how angry you there. There is certainly plenty of value in large gatherings where people loudly express their views, but it will require a bit more creativity than that to really connect with people on a deeper level.

Most people think protests are aimless especially when they are mismanaged and get violent. Such protests instead lead to many socio-economic challenges, which create more problems than before.

However, if clever words and peaceful gestures are used for a protest, it gets more positive attention and hence may change the course of history. Traditionally, protests have been thought of as a way to demand change from the masters, but as we have seen throughout history, this rarely achieves long-lasting change.

The mathematics of the climate crisis is easy to understand once you have the key numbers. And those numbers lead to some clear and compelling conclusions.

Following the well-known laws of physics, carbon dioxide traps and preserves heat in the atmosphere. Without it, we’d be frozen space-bunnies without a gram of civilization to rub between us.

At 280 parts of CO2 per million, it’s a bit hot in the tropics, a bit cold in the Arctic, but overall, as Goldilocks might say, it’s just right. Every spring, when the forests in Earth’s north breathe in CO2, the atmospheric CO2 dips. Every fall, when they release their leaves, it rises. As Joni Mitchell might put it:

The carbon cycles go round and round,

The CO2 goes up and down,

We’re captive on a carousel of time.

The Immense Power of Ancient Fossil Fuels

But starting in the 1760s, when we began to burn the immense power of ancient fossil fuels that date from long before the age of the dinosaurs, the carbon carousel began to get a bit crazy. The yearly variation remains the same, but every year the CO2 rises because of all the ancient carbon we are adding, every molecule of which traps additional heat.

The bill, announced just hours ago, includes:

  • sweeping new powers to access Canadians’ private information2
  • greatly expanded powers for spy agency CSIS, including the power to place Canadians on a no fly list3

  • provisions that allow CSIS to completely override privacy protections in multiple existing laws5

And of course, this all comes without any increase in oversight, and does nothing to address the CSE privacy violations that shocked the world on Wednesday.6
