It’s been exactly 1 month since we elected our new government. And right at this moment, Trudeau is in the process of assigning his next cabinet and preparing a mandate letter for each of his ministers.
This is a critical moment as our new government sets its priorities. We have to ensure that they put the Just Transition Act at the top of the agenda.
Let’s make our voices heard. Sign our petition now to call on Trudeau to make a Just Transition Act the top priority for this new government.
After the summer we’ve just had, of unprecedented wildfires, heatwaves, and droughts, it should be a no-brainer that we need action on the climate emergency, and we need it now.
A Just Transition Act is the best way to ensure that we can phase out fossil fuels and usher in an era of 100% renewable energy in a way that leaves no one behind.

No Justice in Isolation

Dear Friend,
Imagine being isolated in a tiny prison cell for days, weeks, or months on end.
You don’t know when you will be allowed to go out for a walk or some fresh air. When you look up, you see concrete walls and no windows. Often, the only interaction you have with someone else is when you’re handed a meal through a small food slot.
This is the reality for many people who are currently in the prison system. Imprisoned people are being denied basic needs – the ability to go on a walk, to have a conversation with another person, and access to institutional programs. This is not right. Long-term solitary confinement was found to be unconstitutional years ago, and yet, it still happens.
That is why we are going back to court to fight against solitary confinement.

Lytton fire investigation

PAOV — Calls are growing for the Transportation Safety Board to reopen the investigation into the cause of the Lytton wildfire this summer. The TSB has closed the investigation, saying there was no link between railway operations and the fire. Lytton residents feel there are still unanswered questions from the investigation and want it reopened. If you think that the investigation should be reopened, sign the petition now.

As they prep for the Supreme Court of Canada, BLCN poised to set an important precedent.

19 years ago, as Tsilhqot’in Nation was fighting its groundbreaking title case, the Nation accessed a little-known but powerful tool. Called an Advanced Cost Order, it provided funding to pursue a precedent-setting, nationally-important challenge, equipping the Tsilhqot’in to stand up against Canada’s army of justice department lawyers.
It worked. With the financial stamina to pursue the case long-term, the litigation made it to the Supreme Court of Canada. In 2014, a panel of judges unanimously declared that Tsilhqot’in hold Aboriginal title to a large swath of their lands, recognizing the right to proactively control and manage the land. It is the first such declaration from the Court in Canadian history.
At the same time, a new challenge was being shaped by Beaver Lake Cree Nation. With exponential growth of oil and gas projects in their territory, Beaver Lake Cree faced a stark choice: let go of their stewardship responsibilities and allow the tar sands to darkly bloom all around them, or stand up, and defend Treaty 8 in court.
They stood.
But that decision has come at an enormous cost. Strewn in the path have been multiple government attempts to derail the case. It’s all part of a pattern of ‘deny, delay and outspend’ that forces many Indigenous plaintiffs to abandon legal actions due to financial exhaustion.
In 2019, Beaver Lake Cree Nation applied for — and was granted — the same type of Advanced Cost Order that helped Tsilhqot’in Nation go the distance. As those of you who read this newsletter may know, that cost order now hangs in the balance after a cynical appeal by Alberta overturned the lower court ruling. This has forced the Nation into the ugly position of having to argue yet again — on their own dime — that after two centuries of colonialism and state neglect they are indeed impoverished. Now, the fate of their larger treaty case is in jeopardy.
The final reckoning, in the Supreme Court of Canada, comes this November 4th.
Just as treaties are only meaningful if they are upheld, justice is only achievable if it is accessible. Will you help Beaver Lake Cree Nation defend its Advanced Cost Order, and propel this historic treaty rights case forward?

When oil giant Chevron lost a multibillion-dollar environmental lawsuit to a group of Indigenous Ecuadorians, the company refused to pay up — and instead went to war against Steven Donziger, the attorney who won the historic judgment.
Since 2009, hundreds of lawyers from 60 firms have made Donziger’s life a living hell. For the last two years, he’s been under house arrest in New York, forced to wear an electronic ankle monitor — and now he’s facing a six-month prison sentence after refusing to turn over his electronic devices to Chevron’s lawyers.

Didier Thouvenin is a farmer in Vittel, France -- home to one of Nestlé's massive water-guzzling projects.
Together with other whistleblowers, he exposed that Nestlé was illegally dumping huge amounts of plastic and chemical waste, forcing it to admit to creating NINE massive dumping sites.
But instead of cleaning up the mess and apologizing to local residents, Nestlé filed a legal complaint against Didier for trespassing! We know it won’t stop there -- there were 11 other activists with Didier that day and Nestlé is famous for doing everything they can to silence opposition to protect its profits.

TC Energy is ramping up its construction work in Wet’suwet’en territory two years after land and water defenders caught the world’s attention by peacefully resisting the RCMP.
Since then, TC Energy has attempted to keep a low profile, hoping that the world will look away. Recently, they have started encroaching deeper and deeper into Wet’suwet’en territory, and last week they started construction that would endanger the Sacred Headwaters.
Enough is enough: the construction on Coastal GasLink needs to stop now. And we can stop this pipeline if its biggest financial backers pull-out
